These Terms constitute a legally binding agreement between you ("you" or "User") and Quantitative Health, LLC, a Michigan limited liability company ("Company," "we," "us," or "our"), operated by Dr. Paul Kilgore, MD, MPH, FACP.

Paid consultation services offered through the Site (including the Calculator Results Session and Tailored Vitality Coaching program) are health coaching and education services. A formal physician-patient relationship is established only when expressly agreed upon in writing as part of a specific consultation engagement, subject to applicable state licensing requirements.

Consultation services are subject to separate terms and conditions provided at the time of booking.

5. Health Tools and Calculators

The health calculators, analyzers, and assessment tools available on this Site:

Are based on published, peer-reviewed clinical research and validated medical algorithms
Are designed by Dr. Paul Kilgore, MD, MPH, FACP, a board-certified internist and CDC-trained epidemiologist
Produce results based solely on the data you input; inaccurate inputs will produce inaccurate results
Are intended as educational screening tools, not diagnostic instruments
Should be reviewed with your personal healthcare provider before taking any action based on the results
May use artificial intelligence or machine learning components, the outputs of which should be considered informational, not diagnostic

We make reasonable efforts to ensure the accuracy and currency of the algorithms and medical information used in our tools, but we do not warrant that the tools are error-free or that the results are applicable to your specific medical situation.

6. User Responsibilities

By using the Site, you agree that:

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from this Site without the prior written consent of Quantitative Health, LLC, except for your personal, non-commercial use.

8. Privacy

Your use of the Site is also governed by our Privacy Policy, available at drpaulkilgore.com/privacy-policy. By using the Site, you consent to the collection and use of information as described in the Privacy Policy.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE OR SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

12. Indemnification

You agree to indemnify, defend, and hold harmless Quantitative Health, LLC, Dr. Paul Kilgore, and their officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Site or Services, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Oakland County, Michigan, and you consent to personal jurisdiction and venue in such courts.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and Quantitative Health, LLC regarding your use of the Site and supersede all prior agreements and understandings.
